36% ex-inpatients under supervision and treatment acts returning to the hospitals -Article translation 11-

Under "Supervision and Treatment Act", persons who inflicted injuries or committed other crimes become non-prosecuted or suspended for execution, if they are judged as being lack of responsibility due to mental illness.

According to the committee held by the probation office in Nara prefecture on 30th November, it was found that many of these ex-inpatients, who have been treated under this law, have no choice but to remain in the hospital due to the difficulty of finding the place to live, or guarantors.

 傷害などの事件に及んで刑事責任能力が問われず、不起訴や執行猶予になった精神障害者を拘束し、入院治療を強制できる医療観察法をめぐり、退院できる症状に回復した場合でも、住居や保証人が確保できないなどの理由で、社会的入院を余儀なくされる人々が相当数いることが30日、法務省奈良保護観察所(奈良市登大路町)が開いた医療観察制度運営連絡協議会で明らかになった。
